Sceneline Imaging – Terms & Conditions

The following Terms & Conditions apply to all services provided by Sceneline Imaging (“we”, “our”, “us”) to our clients (“you”). By engaging our Matterport 3D virtual tour and imaging services (the “Services”), you agree to these terms, which supersede any prior written or verbal agreements.

Consumers may also hold rights under the Consumer Guarantees Act 1993.

Quotes

Any pricing, timelines, or details we provide in a quote are estimates only and not binding until confirmed. Prices may change without notice and may be adjusted if you request variations or if our rates change before a booking is confirmed.

Orders

Orders are confirmed once we receive your written acceptance (e.g., by email). If no written confirmation is provided, an order will be deemed accepted once we begin work at your requested location.

  • Cancellations must be agreed to in writing. Fees already incurred will be payable, and additional cancellation charges may apply at our discretion.

Payments

  • Unless agreed otherwise, a 50% deposit is required at booking, with the balance due upon delivery.

  • All fees are GST exclusive unless otherwise stated.

  • Payments must be made in full, without deduction or set-off.

Late Payments & Defaults

  • If payment is not received by the due date, we may deactivate or remove access to your virtual tour until payment is made.

  • Fees may be charged on overdue balances at 10% monthly until payment is received.

  • Collection and legal costs related to debt recovery will be your responsibility.

  • If imagery has been deleted due to non-payment, reshoots will require a new booking and fees.

Delivery

Most Services are delivered electronically via email, file link, or direct access to the Matterport platform. Delivery is considered complete once we provide access. We may use alternative delivery methods if required.

Services & Client Responsibilities

  • We strive to deliver Services in a timely manner but are not responsible for delays outside our control.

  • You are responsible for ensuring the property is prepared and accessible on the scheduled date. A minimum of 3 business days’ notice is required for rescheduling. Additional fees may apply for last-minute changes.

  • A representative should be present during scanning sessions.

  • We reserve the right to decline or withhold Services if the property contains inappropriate or unsafe content.

Intellectual Property & Usage Rights

  • All imagery, scans, and associated files remain the intellectual property of Sceneline Imaging and/or Matterport Inc.

  • You are granted a non-exclusive, non-transferable license to use the content for business or marketing purposes only.

  • You may distribute links, embed codes, snapshots, or floor plans provided under your package.

  • We reserve the right to use captured imagery as portfolio samples for our own marketing unless otherwise agreed in writing.

Risk of Loss

Responsibility for use of delivered Services transfers to you upon delivery. While we take reasonable steps to protect files, we are not liable for data loss once delivered.

Subcontracting

We reserve the right to engage subcontractors or partners to assist in delivering Services.

Privacy & Personal Information

We collect and store personal information (such as contact details) solely for communication, billing, and service delivery. Your data will be stored securely and not shared with third parties without your consent. You may request access to, or correction of, your information at any time.

Warranties & Liability

  • We warrant that our Services will be delivered with reasonable skill and care.

  • We do not guarantee Services will be error-free or uninterrupted.

  • To the maximum extent permitted by law, we exclude liability for indirect or consequential losses, including lost profits, data, or opportunities.

  • Where liability cannot be excluded, our total liability is limited to the value of the Services purchased.

Refunds

Refunds will only be considered for prepaid hosting fees where Services cannot be delivered due to external restrictions (e.g., Matterport platform limitations). No other refunds will apply unless agreed in writing.

Measurements

While our virtual tours include measurement features that provide approximate dimensions of spaces, these measurements are intended for general reference only and should not be relied upon as exact or definitive. Variances may occur due to factors such as scanning limitations, irregular surfaces, or user input.

Sceneline Imaging makes no guarantee or warranty as to the accuracy or completeness of any measurements generated within the virtual tour. Customers are strongly advised to obtain independent professional measurements before making decisions related to construction, renovation, purchasing, or any other activity requiring precise dimensions.

By using the measurement tool within our virtual tours, the customer acknowledges and accepts that Sceneline Imaging shall not be held liable for any loss, damage, cost, or claim arising from reliance on these measurements.

Consumer Rights

Nothing in these Terms affects rights under the Consumer Guarantees Act 1993 for non-business consumers. Where Services are acquired for business purposes, the provisions of the Act do not apply.

General Conditions

  • Failure to enforce any clause does not waive our rights under these Terms.

  • You may not assign or transfer obligations without our consent.

  • If any clause is found invalid, the remaining provisions remain enforceable.

  • These Terms are governed by New Zealand law, and disputes are subject to the jurisdiction of New Zealand courts.
